In 1807 the War of 1812 was a few years away, but the preliminaries of that war were taking place in New York Harbor. In the midst of that a Third Regiment of Artillery be appointed to protect the harbor. Major Snowden was transferred from the Second Artillery and appointed Second Major. He would soon be promoted to First Major of the Regiment. On June 9th he would be promoted to First Major of the Third Regiment of Artillery. Benjamin Ayerigg was made Second Major. In June of 1807, before this regiment of artillery could be completed, an affair of immense national security took place. The American frigate Chesapeake was boarded by the British Man-of-War Leopard and four seaman removed as they were claimed British citizens. Mayor DeWitt Clinton and the citizens of New York were alarmed that their harbor was not safe. President Thomas Jefferson issued a proclamation that all British war vessels were to immediately leave American harbors and that states should increase their rolls of active military by 100,000. This would lead to an increased urgency in completed the rolls of the Third Regiment of Artillery. A violent altercations between Snowden and Ayerigg officer lead to his arrest in August of 1807. He would be exonerated of all charges, released from jail, and put back in charge of the Second Battalion."[History of the Seventh Regiment of New York, 1806-1889" by Clark
