Ultra rare but with serious condition issues. Opinion of Referee, August 22, 1864, in the case of Gould & Curry Silver Mining Co., plaintiff, vs. North Potosi Gold & Silver Mining Co., defendant, in the District Court, First Judicial District, Storey County, Nevada Territory. Printed by Goodman & McCarthy, Enterprise Office, Virginia, N.T. 12 pp. 5.5 x 8.75" Orange wrappers. Very poor condition with heavy soiling, foxing, brittle pages, binding loose, etc. Fragile. Please inspect. This case took on the infamous "One-Ledge Theory" of the territorial days. The North Potosi had been located on a blind ledge adjoining the Gould & Curry. When the Potosi ran a tunnel and found a fissure of rich ore in the hanging wall lying east of the Gould & Curry, they claimed it was a separate vein. The Gould & Curry said it was one of the many vertical fissures in the hanging wall. The referee found that the Comstock was a true fissure vein, and that the North Potosi fissure was part of the Gould & Curry claims. The one-ledge theory had prevailed. (Sutro-Comstock Collection)
