What a jam packed set of legal documents on three legal pages from 1845 that were transcribed in 1853. They show the route that Maria de Jesus Bernal had to take to get land 300 vara (33 1/3") in length and 200 vara in breadth. She asked for it to be on the banks of the Spring and Asequia near the Mission Santa Clara. She was asking for "a piece of land that is needed to build a house with an orchard and for sowing for the maintenance of her family." She does say she has the blessing of Father Real. (Father Real was quite a character. He was actually a Spanish missionary who rode horseback, played with the children and hunted grizzly bears. He is described as not a stern as other missionaries. [Tales of Old California by Oppel]

Four approvals were needed to acquire this lot including that of the Prefecture of the Second District, Antonia Maria Pico. (Oico was granted the Rancho Pescadero in 1843. It encompassed an area of 35,446 acres and included the area that would later become the City of Tracy.) Next came Francis (or Francisco) Guerrero, Prefecture of the Second District at Yerba Buena (San Francisco). Manuel Castro approved the documents presented. Finally AJ Yates affirms the accurateness of the documents.

Maria de Jesus Bernal's nickname was "Jesus" but she was baptized Maria Timotea de Jesus Bernal at the Mission Santa Clara on 24 January 1820. Maria de Jesus Bernal married first "Tom the Trapper" who used the name Thomas L. Tomlinson on May 11, 1837 at San Juan Bautista. He was quite a character. They had a son Tomas who died at the age of five. She remarried on 3 August 1845 in Santa Clara. It is at this time she applied for the land on the Banks of the Spring and Asequia. Some staining. Difficult to read only in the fact that the document was written 165 years ago!
