Lincoln's first postmaster general and counsel to Dred Scott, Montgomery Blair served as postmaster for 4 years, but resigned at Lincoln's request to keep peace in the cabinet. As council to Dred Scott, he was involved in one of the most famous U. S. Supreme Court opinions. Signature clipped from album page: "M. Blair / of Maryland." The carte de visite (2 1/2 x 4 inches) shows him seated, full length. Imprinted on reverse: Published by E. Anthony / 501 Broadway, N.Y. / From / photographic negative / from / Brady's National / Portrait Gallery.
On Dred Scott's behalf, Blair argued that the black man had spent in the free states of Illinois and Minnesota made him a free man. The Court's ruling against Scott's right to freedom is often cited as a cause of the Civil War. Writing for the majority, Chief Justice Roger B. Taney affirmed that the black man had no rights, and that black slaves could not be considered American citizens. Conservative on other subjects, Blair's work for Dred Scott suggests more progressive attitudes.
