A long history of scandal and fraud led to the formation of the New Monte Cristo MC. C. C. Julian was an aggressive promoter, some would say con artist. "The history of the promotion of this company and its predecessors is replete with legal difficulties, largely because of the methods used in the stock selling campaigns. Characterized by extravagant statements the promoter's somewhat flamboyant advertising drew the fire of the California Corporate Commission. The selling of capital stock in the Western Lead Mines Co (one of the companies controlled by Julian) was first banned in 1926, when at a hearing in May, the evidence introduced led to the opinion that "the sale would be unfair, unjust and inequitable to the purchasers thereof."

Following this the promoters bought control of the Monte Cristo M&MC, secured the two British Columbia properties, and the Ballas mine in Arizona...which was placed under the control of the Julian Merger Mines Co, which the promoters tried to 'put over' contending that this corporation, organized under the laws of the District of Columbia, was excluded from the Corporate Securities Act of California." The California State Commissioner banned the sale of the Julian Merger Co leading to the formation of the New Monte Cristo M&MC. (Mines Handbook, 1931, p.627-28). We placed this company in Los Angeles, where the principal office was located. The company owned property in several places.
